Chimanimani West MP Engineer Mutezo axed from Parliament

Former Energy and Power Development Deputy Minister Engineer Munacho Mutezo has been axed from Parliament and representing Chimanimani West constituency after his expulsion from Zanu-PF last week.
In terms of the Constitution a Member of Parliament loses his/her seat after he/she ceases to belong to a political party where he/she was a member of.
Eng Mutezo’s ouster comes after the Politburo upheld recommendations by the Zanu-PF disciplinary appeals and review committee of the Central Committee, chaired by Vice President Phelekezela Mphoko, to expel the legislator after he failed to defend himself on the allegations he was facing in Zanu Pf.
Section 129 (k) of the Constitution states: “The seat of a Member of Parliament becomes vacant if the member has ceased to belong to the political party of which he or she was a member when elected to Parliament and the political party concerned by written notice to the Speaker or the President of the Senate, as the case may be, has declared that the Member has ceased to belong to it.”
Speaker of the National Assembly Jacob Mudenda yesterday officially announced Mutezo’s expulsion from Parliament.
“I would like to inform the House that on the 16th August 2016, I was notified by the Zimbabwe African National Union Patriotic Front (ZANU PF) that Mr. Munacho Mutezo, a Member of the National Assembly for Chimanimani Constituency had ceased to be a Member of ZANU PF.  Therefore, he no longer represents the interest of the party in Parliament,” he said.
Advocate Mudenda declared Chimanimani west constituency duly vacant.
“Consequently, a vacancy has arisen in Chimanimani West Constituency by operation of the law.  The necessary administrative measures will be taken to inform His Excellency the President of the Republic of Zimbabwe and the Zimbabwe Electoral Commission (ZEC) for the existence of the vacancy in line with Section 39 (1) of the Electoral Act, Chapter 213 as amended,” said Adv. Mudenda.
The expulsion of Eng Mutezo from Parliament comes hard on the heels of the recall of Norton legislator Mr Christopher Mutsvangwa after Zanu-PF said he had remained unrepentant.
